These Terms and Conditions (Terms) form a legal agreement between ParkMate Limited (ParkMate, We, Us, Our), and You, the Customer (You or Your), for ParkMateโ€™s parking application and related services (ParkMate App).

1.Terms of Use

1.1. Acceptance of Terms: By registering with ParkMate and accessing or using the ParkMate App You accept these Terms. Please read these Terms before You register to use the ParkMate App. If You do not accept these Terms, You must not use the ParkMate App.

1.2. Defined Terms: You should refer to clause 14 below for the interpretation of words and expressions used in these Terms.

1.3. Customer Parking Terms: These Terms must be read together with the โ€œParkMate Terms and Conditions: Customer Parkingโ€ (Customer Parking Terms) which can be viewed on our website or in the ParkMate App, car park details

1.4. The Customer Parking Terms are applicable when You use the ParkMate App to arrange for a Carpark Space. If there is a conflict between these Terms and the Customer Parking Terms, then the Customer Parking Terms will take precedence.

1.5. Amendments: We can update these Terms from time to time. You can review the most current version of the Terms at any time on the ParkMate App or on the Website. By continuing to use the ParkMate Services after We have published revised Terms on the ParkMate App or the Website, You agree to be bound by the revised Terms and Conditions. It is Your responsibility to check the ParkMate App and the Website periodically for changes and be familiar with these Terms at all times.

2.Your Account

2.1.Registration:

2.1.1. Becoming a registered Customer of ParkMate is free. You must become a registered Customer before You can use the ParkMate Services.

2.1.2. Once registered You may use the ParkMate App to purchase electronic passes for parking Sessions at a Carpark Site.

2.1.3. You will need to provide some information to ParkMate to allow Us to identify You and for Us to charge You the applicable parking fees.

2.1.4. You must not allow other parties to use Your ParkMate account and You must not impersonate other parties in any registration whether or not You know the person or business.

2.1.5. In using the ParkMate Services, You must observe and conform to all parking compliance rules or directions displayed in the Carpark Sites and to comply with all relevant laws and regulations relating to the use of the Carpark Sites and the Customer Parking Terms.

2.2.Account Information and Payment Details

2.2.1. By using the ParkMate App, You agree to provide accurate and complete personal information, including Your licence plate number, email address and banking details as required by ParkMate. We may contact You to verify these details.

2.2.2. You warrant that You have provided complete, accurate and current information when registering with ParkMate.

2.2.3. You must ensure that the personal information and payment details You provide Us are kept up to date at all times.

2.2.4. Failure to provide accurate and complete personal information and payment details may result in parking breach notices, penalties or other legal action.

2.2.5. If You discover an error in the personal information or payment details that You have provided Us, You are responsible for immediately updating this information.

2.2.6. You acknowledge that ParkMate will not be liable for any errors or inaccuracies in the personal information or payment details that You have provided.

2.2.7. You are responsible for maintaining the security of Your account and for all activities that occur under Your account, including any unauthorised use. If You suspect Your account has been compromised, You must immediately contact ParkMateโ€™s Customer care team on 09 375 5056 and take all necessary steps to secure Your account.

2.2.8. You will not use the ParkMate App to publish any misleading, false, offensive, defamatory, fraudulent, or illegal information or content.

2.2.9. We reserve the right to remove any content from Your account at Our sole discretion.

2.3. Closing Your Account:

2.3.1. You may close Your account at any time using the ParkMate Website.

2.3.2. To close Your account, You must visit myaccount.parkmate.co.nz.

2.3.3. Once Your account is disabled, Your account information is kept by Us for a period of time where required by Us to meet Our statutory obligations.

2.3.4. You are free to request from ParkMate details of the information which has been retained by contacting support@parkmate.co.nz.

3. Parking and Transaction Fees

3.1. ParkMate will charge You the parking fees applicable plus an electronic Transaction Fee (Surcharge) each time You make a payment using your credit card or contactless debit card for these ParkMate Services.

3.2. When You purchase parking through the ParkMate Services You are authorising ADVAM to debit Your nominated credit/debit card(s).

3.3. Parking fees are charged in New Zealand Dollars and include GST, if applicable. Please note that these fees may be subject to change periodically, without prior notice.

3.4. If You believe You are entitled to a refund, please complete our online refund request form with all the required information as to why a refunds should be considered

3.5. The refund process and conditions are stated in section 4.Refund Requests in these terms and conditions

3.6. When using the ParkMate Services, You are responsible for first locating an available Carpark Space, parking Your vehicle, and then paying for that Carpark Space. We cannot and do not guarantee that a Carpark Space will be available, even if payment is made before parking

4. Refund Requests

4.1. ParkMate aims to provide a seamless parking experience. However, We understand that certain circumstances may require a refund. Refunds will be considered on a case-by-case basis in line with the following conditions

4.2. Refunds may be granted under the following conditions:

4.2.1 System Errors โ€“ If a technical error in the ParkMate app or payment system results in an incorrect charge.

4.2.2 Duplicate Payments โ€“ If You are inadvertently charged multiple times for the same transaction.

4.2.3 Overpayment โ€“ If an overpayment occurs due to an identifiable error.

4.2.4 Cancelled or Failed Transactions โ€“ If a payment is processed despite a failed or cancelled parking session.

4.2.5 Unauthorised Charges โ€“ If You provide evidence of an unauthorised transaction (subject to investigation).

4.3. Refunds will generally not be provided in the following cases;

4.3.1 Change of Mind โ€“ If You decide You no longer wish to use the parking session You paid for or You select the incorrect product or session

4.3.2 Incorrect Parking Duration โ€“ If You input incorrect duration details or select a session with duration details longer than You intended and fail to correct them before confirming payment.

4.3.3 Completed Parking Sessions โ€“ If parking has been used as per the parking session confirmation.

4.3.4 Failure to Comply with Parking Terms and Conditions โ€“ If You receive a breach notice due to non-compliance with Terms and Conditions.

4.4. To request a refund You must

4.4.1 Complete Our online refund request form here and provide the following details

โ€ข Vehicle License Plate
โ€ข Requested Refund Amount
โ€ข Reason for the refund request
โ€ข Transaction Date
โ€ข Supporting evidence (e.g., screenshots, receipts, error messages)

4.5. Processing and Timelines

4.5.1 ParkMate will review the refund request and intend to respond within 5 business days

4.5.2 If approved, Refunds will be processed via:

4.5.2.1 The original payment method if the refund reason is listed under 4.2 above

4.5.2.2 As credit to ParkMate Balance if the refund reason is due to Your error

4.5.3 If processing a refund via the original payment method where that method is a debit or credit card a surcharge of 1.75% will be deducted to cover merchant fees

4.6 Dispute Resolution

4.6.1 If You dispute a declined refund request, You may escalate the matter by contacting ParkMate customer support.

4.6.2 If unresolved, You may seek guidance from relevant consumer protection authorities.

4.7 Amendments to the Refund Policy

4.7.1 ParkMate reserves the right to update this refund policy at any time. Changes will be communicated via the ParkMate app, email or website

5 Automated Licence Plate Recognition (LPR)

5.5 Automated Licence Plate Recognition (LPR) is a feature within the ParkMate App which once toggled on can automatically start and stop a Session.

5.6 Once the LPR feature is toggled on, You will receive a description as to what LPR is, how You can best use it to Your own benefit and important Terms and Conditions that You should be aware of.

5.7 Carpark Spaces that are equipped with LPR technology automatically record the licence plate details of vehicles entering and exiting the Carpark Site.

5.8 LPR connects Your vehicleโ€™s number plate with Your ParkMate account and Your selected payment method.

5.9 When the on-site cameras recognise and authenticate Your vehicleโ€™s licence plate, ParkMate will automatically start a Session and allow You to park Your vehicle and deduct the parking costs from Your payment method. Please note that ParkMate cannot guarantee that the LPR cameras will always recognise Your vehicleโ€™s number plate.

5.10 ParkMate shall not be held liable for any failures of the LPR system or breaches of the Customer Parking Terms that may occur because of the systemโ€™s failure to automatically start and stop a parking Session. The responsibility for ensuring a valid parking Session, rest solely with the Customer.

5.11 To use LPR You need to toggle on LPR for each licence plate that is added to Your ParkMate account under Settings > My Vehicles. Each licence plate must be unique to one ParkMate account only, otherwise You will not be able to toggle this feature on.

5.12 Once LPR has been activated for that licence plate, that plate will be eligible for automated LPR Sessions when the vehicle enters a Carpark Site even if someone other than You parks the vehicle.

5.13 Each time one of the vehicles linked to Your account enters and exits a Carpark Site with LPR, You agree to pay all applicable parking fees via the ParkMate App and Your selected payment method in accordance with these Terms.

5.14 You will be liable for all applicable parking fees and charges incurred by any vehicle linked to Your account even if someone other than You, parks the vehicle at the Carpark Site.

5.15 By using the ParkMate LPR functionality, You agree that payment for any parking fees will be automatically deducted from Your designated payment method as described above.

5.16 You remain responsible for adding Your credit/debit card details and/or banking details and plate number to the ParkMate App and ensuring that sufficient funds are available for payment. Failure to do so may result in additional fees or penalties.

5.17 You are responsible for ensuring that any vehicle registered against Your account is up to date and accurate. If a vehicle registered against Your account is lost, stolen, sold or lent to someone else, You must remove the vehicle from Your profile details immediately or notify ParkMate, and We will remove it for You.

5.18 The licence plate information collected by the LPR system will be used for the purpose of managing parking Sessions and operating the Carpark Site, including enforcing parking regulations and collecting parking fees.

5.19 The LPR system may also be used for security and safety purposes, such as identifying stolen vehicles or vehicles involved in criminal activity.

5.20 The licence plate information collected by the LPR system together with Your personal information will be kept confidential and will not be shared with third parties except as set out in Our Privacy Policy which can be found [here] or as required by law, or for the specific purposes outlined in these Terms.

5.21 We have implemented appropriate technical and organisational measures to protect the security of the personal information that We collect using LPR technology.

5.22 You have the right to request access to Your personal information and to request that any inaccuracies be corrected. If You have any concerns about Our use of LPR technology or the protection of Your personal information, please contact Us on 09 375 5056.

5.23 By entering the Carpark Site, You consent to the use of Your licence plate information as described in these Terms.

6. ParkMate Balance

6.1. ParkMate Balance: ParkMate balance is a method of payment that allows You to top up Your account with funds and use this as a payment method for Your ParkMate purchases (ParkMate Balance). It has auto renew functionality that allows You to set customised limits and allows Your ParkMate account to automatically top up Your balance when it drops below a set level (Auto Renew).

6.2. Use of ParkMate Balance: In using ParkMate Balance, You will:

6.2.1. comply with all notices, policies, and instructions relating to the use of Your ParkMate Balance and Products that ParkMate may issue from time to time; and

6.2.2. provide ParkMate with any information and assistance that it may reasonably request relating to the issue, use, suspension, and cancellation of Your ParkMate Balance.

6.3. Products, Use and Charges:

6.3.1. A Surcharge is applied when credit is added to Your ParkMate Balance. This Surcharge is non-refundable.

6.3.2 ParkMate Balance credit purchases are non-refundable. See clause 6.4 (Cancellation and Refund) for more information.

6.3.3 There is a minimum top up amount of $5.00 and maximum of $1000.00 when topping up Your ParkMate Balance.

6.3.4 The maximum amount of funds that can be loaded on any single ParkMate account at any one time is $1000.00.

6.3.5 You can enable Auto Renew for Your ParkMate Balance through Your ParkMate account by providing Your debit/credit card information and specifying the minimum threshold and desired top-up amount in Your ParkMate account settings. By submitting Your payment details and activating Auto Renew, You authorise ParkMate to automatically add funds to Your ParkMate Balance.

6.3.6 You must also provide details of Your preferred ParkMate Balance threshold and top up value, and acknowledge that this information will be stored in Your ParkMate Balance account.

6.3.7 If Your Auto Renew top-up settings will cause Your ParkMate Balance to exceed $1000.00, the top-up will only bring Your balance to the $1000.00 limit. For example, if You have $600.00 credit and set a $600.00 Auto Renewal limit, Your ParkMate Balance will only be auto topped up $400.00 to reach the $1000.00 limit.

6.3.8 You further acknowledge that You may not receive advance notice of direct debit/credit card payments for each Auto Renewal top up, but that We will notify You by email once the Auto Renew has been triggered and processed; and

6.3.9 Failed Auto Renews will not be retried. If a payment is unsuccessful for any reason, You will be notified by email, and it is Your responsibility to update payment methods and restart Auto Renew.

6.4 Cancellation and Refund:

6.4.1 No refunds will be provided where You have not managed the payment settings or Auto Renew settings for the purchase of ParkMate Balance.

6.4.2 ParkMate reserves the right to deduct the Transaction Fee / Surcharge from a refund amount should there be costs associated with processing a refund of ParkMate Balance. These Transaction Fees / Surcharges include, but are not limited to, bank or Merchant fees and Administration costs.

6.4.3 If You no longer wish to use Your ParkMate account, You may cancel and delete it and request a refund of Your unused ParkMate Balance within 14 days of account closure.

6.4.4 Only unused ParkMate Balance can be refunded. No refunds are available for outstanding passes, Products purchased or Surcharges. Any refund given by Us is inclusive of any goods and services tax (GST).

6.4.5 ParkMate may cancel Your ParkMate account and forfeit any of Your ParkMate Balance if You breach these Terms and ParkMate determines the breach to be fraudulent or constitute payment evasion. Any Products remaining on the ParkMate account at the time of cancellation will be forfeited and become the property of ParkMate.

6.4.6 If Your unused ParkMate Balance is negative, or there are outstanding payments due by You for ParkMate Services used, ParkMate retains the right to recover the negative ParkMate Balance or outstanding payments and may engage a collection agency, with the costs of such recovery being Your responsibility.

6.4.7 Your ParkMate Balance is non transferrable to other ParkMate accounts.

6.24 In order to request a refund of Your unused ParkMate Balance, please complete our online refund request form with all the required information https://parkmate.co.nz/terms-and-conditions/

6.4.8 ParkMate will process a refund of Your unused ParkMate Balance within 10 business days of receiving Your request.

6.5 Other Rights:

6.5.1 ParkMate may refuse to provide any information regarding Your ParkMate Balance if You do not supply all reasonably requested information to verify Your identity as the lawful holder of the relevant ParkMate account and ParkMate Balance.

6.5.2 You must ensure Your contact and payment details associated with Your ParkMate account are kept up to date and correct.

6.6 Your Responsibilities: You are responsible for:

6.6.1 safeguarding Your payment methods and ParkMate Balance against loss, damage, and theft, and ensuring that Your ParkMate account and Your ParkMate Balance are not used by any unauthorised person;

6.6.2 confirming ParkMate Balance is a valid payment method for the specific Products and ParkMate Services You intend on purchasing prior to adding funds to Your ParkMate Balance; and

6.6.3 managing all aspects of Your ParkMate Balance, including Auto Renew settings. No refunds will be provided for instances where You have not managed these correctly.

6.6.4 In cases of user error, should ParkMate accept a refund request we reserve the right to

6.6.4.1 process refunds to ParkMate Balance;

6.6.4.2 if processing a refund back to the userโ€™s credit card a surcharge of 1.75% will be deducted.

6.7 ParkMateโ€™s Responsibility: ParkMate:

6.7.1 allows You to use Your ParkMate Balance for payment of Products and ParkMate Services through the ParkMate App. However, there may be occasions where Your ParkMate Balance may not be valid as a payment method. It is Your responsibility to confirm the eligibility of Your ParkMate Balance for specific purchases; and

6.7.2 is not obligated to prevent the use of a lost or stolen ParkMate Balance acquired through fraud or deception, nor is it required to transfer any credit or products purchased with that balance to another ParkMate account.

6.8 Right to Refuse: ParkMate reserves the right to reject Your use of Your ParkMate Balance for payment of Products or ParkMate Services if:
6.8.1 your ParkMate Balance is suspended, expired, or cancelled, regardless of whether notice is provided to You regarding such expiration, suspension or cancellation;

6.8.2 ParkMate suspects that Your ParkMate Balance has been fraudulently or deceptively obtained;

6.8.3 your ParkMate Balance is insufficient or has been depleted;

6.8.4 the system is unable to process the payment for any reason whatsoever, or any circumstance arises which prevents Your ParkMate Balance from being used as a payment method; or

6.8.5 you fail to comply with these Terms.

6.9 Determination of ParkMate Balance and Other Products:

6.9.1 ParkMateโ€™s determination of the ParkMate Balance on a ParkMate account will be final and binding. ParkMate reserves the right to adjust Your ParkMate Balance if it identifies a technical or accounting error has occurred. This balance determined by ParkMate will be considered conclusive and legally binding.

6.9.2 This determination is based on ParkMateโ€™s records, including system-generated records. If ParkMate finds that an error caused an incorrect deduction from Your ParkMate account for a transaction, it will refund the difference to Your ParkMate Balance.

6.10 Right to Retain: ParkMate will be entitled to retain any of Your ParkMate Balance which it suspects, or has reason to believe, has been fraudulently issued, stolen, or used in breach of these Terms.

6.11 Co-operation: You agree to co-operate with ParkMate and, if applicable, the New Zealand Police, in the event of any suspicion of suspicious behaviour or activity in relation to Your ParkMate Balance.

6.12 Expiry: Your ParkMate Balance will expire six years after the last used date if:

6.12.1 it remains unused for a continuous period of six years; and

6.12.2 no refund is requested within six years of the last used date.

6.13 Suspension: ParkMate may suspend Your use of Your ParkMate Balance if You breach any of these Terms and such breach is determined by ParkMate to constitute fraud or payment evasion. In the event of a suspension:

6.13.1 the suspension will remain in force for a period directed by ParkMate; and

6.13.2 ParkMate may require the payment of a reasonable administration fee and may impose additional Terms deemed necessary as a condition of reactivation of Your suspended ParkMate Balance.

6.14 Obligation to Examine: It is Your responsibility to check Your ParkMate Balance on purchase or issue and on each addition or subtraction of Products and purchases to the ParkMate Balance.

6.15 Transaction Details:

6.15.1 All transaction details using Your ParkMate Balance will be recorded and retained by ParkMate

6.15.2 You will be able to view transaction history details of Your ParkMate account via the ParkMate Website or the ParkMate App. You will be able to check the balance of Your ParkMate Balance via the ParkMate Website or the ParkMate App.

6.15.3 ParkMate will make every effort to update Your transaction history promptly after each transaction. However, delays may occur in updating certain transaction history one or more days after the transaction took place.

6.15.4 ParkMate reserves the right to add or update any online transaction history at any time.

7 ParkMate Multi-Pass and Subscriptions

7.1 ParkMate Multi-Pass: The Multi-Pass function is available via the ParkMate App and allows You to prepay a specific quantity of Multi-Passes in bulk that can be used for an unreserved Carpark Space in one or more specific Carpark Sites, for one or more uses, in a defined period (Multi-Pass).

7.2 ParkMate Subscriptions: The subscription function is available via the ParkMate App and allows You to subscribe to a long-term product which allows full access during the Carparkโ€™s operating hours to an unreserved bay in the Carpark for the defined period of the subscription (Subscription)

7.3 Use of Multi-Passes: Multi-Passes:

7.3.1 are valid only for the number of permitted entries, price, vehicle registration and for the one or more Carpark Sites specified in the Multi-Pass. Use in excess of the number of permitted entries, other locations, and use of other Products, will incur fees at casual parking rates;

7.3.2 are valid only for use within 3 months of the date of purchase of the Multi-Pass.

7.3.3 are not refundable in whole or part, even if You do not use any of Your individual Multi-Passes;

7.3.4 may be used at the selected Carpark Sites included in the purchase but are otherwise non-transferable to any Carpark Sites outside of those selected;

7.3.5 cannot be resold or leased to any person;

7.3.6 are subject to redemption of each individual Multi-Pass by selecting the Multi-Pass as the payment method via the ParkMate App,

7.3.7 redemption of the daily pass Multi-Pass bundle is subject to availability of Carpark Spaces at the selected Carpark Site at any given time;

7.3.8 may be cancelled by ParkMate without notice and without liability if ParkMate is unable for any reason to provide the ParkMate Services selected; and

7.3.9 If Your Multi-Pass is cancelled, no charges will apply. ParkMate will promptly refund or cancel any fees You have already paid or incurred.

7.4 Use of Subscriptions: Subscriptions:

7.4.1 are valid only for the number of permitted entries, price, vehicle registration and for the one or more Carpark Sites specified in the Subscription. Use in excess of the number of permitted entries, other locations, and use of other Products, will incur fees at casual parking rates;

7.4.2 are valid only for use within the period of the Product from the date of purchase of the Subscription;

7.4.3 are not refundable in whole or part, even if You do not use any of Your Subscription;

7.4.4 may be used at the selected Carpark Sites included in the purchase, but are otherwise non-transferable to any Carpark Sites outside of those selected;

7.4.5 cannot be resold or leased to any person; and

7.4.6 may be cancelled by ParkMate without notice and without liability if ParkMate is unable for any reason to provide the ParkMate Services selected.

7.4.7 If Your Subscription is cancelled, no charges will apply. ParkMate will promptly refund or cancel any fees You have already paid or incurred.

7.5 Multi-Pass General Conditions:

7.5.1 The responsibility for ensuring Multi-Pass is selected as the payment method for a valid Session rests solely with You. No refunds or credits will be given where errors in payment selection have been made by You.

7.5.2 In cases of user error, should ParkMate accept a refund request we reserve the right to

7.5.2.1 process refunds to ParkMate Balance;

7.5.2.2 if processing a refund back to the userโ€™s credit card a surcharge of 1.75% will be deducted.

7.5.3 Multi-Pass prices may change from time to time. However, any price changes after Your purchase will not affect Your existing Multi-Pass. If You have chosen the Auto Renew feature, the price of the new Multi-Pass may differ from the previous one.

7.5.4 ParkMate will not communicate any price changes for Multi-Passes prior to the Auto Renew of that Multi-Pass outside of any normal day to day prices changes already being communicated. Price details of the new Auto Renew Multi-Pass will be included in the purchase confirmation email sent to You. ParkMate will not refund any price differences for Auto Renew purchases of Multi-Pass.

7.5.5 If a Carpark Site is temporarily closed, You may request an extension to the expiry of Your Multi-Pass but no refunds will be given. Multi-Passes are not transferrable to a different Carpark Site.

7.5.6 If a Carpark Site is permanently closed, any valid Multi-Passes will be refunded on a pro-rata basis either to Your ParkMate Balance or Your purchase payment method used for the purchase.

7.6 Multi-Pass Fees:

7.6.1 A Transaction Fee (Surcharge) applies when purchasing a Multi-Pass and You select a payment method such as credit card or contactless debit card. This Transaction Fee (Surcharge) is non-refundable.

7.6.2 Multi-Pass purchases are non-refundable. See clause 6.7 (Cancellation and Refund) for more information.

7.6.3 You can enable Auto Renew for Your Multi-Pass through Your ParkMate account by providing Your debit/credit card information and selecting the Auto Renew function on the purchase. By submitting Your payment details and activating auto top-up, You authorise ParkMate to automatically add another Multi-Pass identical to the one purchased once all passes have been redeemed.

7.6.4 You further acknowledge that You may not receive advance notice of direct debit/credit card payments for each Auto Renew, but that ParkMate will notify You by email once the Auto Renew has been triggered and processed.

7.6.5 Failed Auto Renews will not be retried. If a payment is unsuccessful for any reason, You will be notified by email, and it is Your responsibility to update payment methods and restart Auto Renew.

7.7 Cancellation and Refund:

7.7.1 No refunds will be provided for instances where Customers have not managed the payment settings or Auto Renew settings for the purchase of Multi-Pass.

7.7.2 ParkMate reserves the right to deduct the Transaction Fees from a refund amount should there be costs associated with processing a refund of Multi-Pass. These Transaction Fees include, but are not limited to, a payment Surcharge, bank or Merchant fees and administration costs.

7.7.3 If You no longer wish to use Your ParkMate account, You may cancel and delete Your account and request a refund of Your remaining Multi-Pass value within 14 days of account closure.

7.7.4 Only unused Multi-Pass value can be refunded. No refunds are available for outstanding passes, Products purchased or Transaction Fees. Any refund given by Us is inclusive of any goods and services tax (GST).

7.7.5 ParkMate may cancel any ParkMate account and Multi-Passes if You breach these Terms and ParkMate determines the breach to be fraudulent or constitute payment evasion. Any Products remaining on the ParkMate account at the time of cancellation will be forfeited and become the property of ParkMate.

7.7.6 Your Multi-Passes are non-transferrable to other ParkMate accounts.

7.7.7 ParkMate account holders may need to provide ParkMate with a valid bank account number to process a refund of remaining Multi-Passes following the closure of the ParkMate account. This must be confirmed via an email to support@parkmate.co.nz and will be processed within 10 business days of receiving the request.

8 Privacy

8.1 Privacy Policy: By accepting these Terms, You acknowledge Our Privacy Policy. Our Privacy Policy sets out how We collect, use, store and disclose personal information. To view Our Privacy Policy please click [here].

8.2 Personal Information: ParkMate collects Your personal information to provide You with Our services. This may include Your name, username, password, email address, physical address, phone number, and other details when You sign up, respond to an email, join Us on social media, or contact Us for support. Supplying personal information is optional; however, without it, we may not be able to offer You all or some of the ParkMate Services.

8.3 Information We Collect Automatically: We also collect certain types of information automatically when You use Our ParkMate Services. Such information may include ParkMate App and Website usage data, transaction information such as time, vehicle plate, amounts charged and Your locations. We may also collect information about how You have used the ParkMate Services, for example if You have used a link to the Website, Your IP address, access times and device information. We may use cookies and other technologies to collect and store information when You use the ParkMate Services.

8.4 Information We Get From Third Parties: We may also obtain information from third parties to help Us verify information supplied or processed, for example transactions, social media outlets or marketing agencies.

8.5 How We Use Your Data:

8.5.1 We may use Your personal information to help provide the ParkMate Services to You and others, and to report to You by using the data collected and displayed through the Website or ParkMate App.

8.5.2 You agree that We may also use this information for internal research purposes, to verify Your identity, for promoting and marketing Our Services, Our Merchants and their Services and Our Partners and their Services to You, to monitor the security of our car parking facilities, to send you a breach notice or reminder of a breach of our terms and conditions of parking and for any other use that You authorise. We may also analyse Your information and the information of others (sometimes using third parties) to help improve the ParkMate Services.

8.5.3 Notwithstanding any other provision of these Terms, ParkMate may make non-specific information about its business (e.g. numbers of Customers, geographic spread, turnover, transaction types and value etc.) available to prospective investors, bankers and purchasers for due diligence purposes. In the event of the sale of any or all of the ParkMate business, Your information may be released to the purchaser for the purpose of continuing the ParkMate Services.

8.5.4 If You donโ€™t believe You have an account or relationship with Us, but think that someone has entered Your personal data into Our systems via the Website services or ParkMate App, You will need to contact ParkMate who will be able to assist and review the situation, although ParkMate may not be able to give any information out to You due to the other partyโ€™s privacy requirements. ParkMate will do its utmost to assist and deal with this situation based on current governing law.

8.6 Who We Disclose Your Personal Information to: In order to provide, manage and improve the ParkMate Services, We may need to disclose Your personal information to other companies in Our group and to Our contractors for the purposes of companies in Our group or Our contractors to carry out their services and operations. We will ensure that these parties will use Your personal information in accordance with the ParkMate Privacy Policy.

9 Security of Your Information

9.1 Login Information: You are responsible for keeping Your login information, including Your username and password, secret and secure. Without limiting the foregoing, You agree to not permit any other person to use Your user login information, and not to disclose, or provide to any other person Your username, password or any other information in connection with Your user identification that may allow them to gain access to Your ParkMate account.

9.2 Security: ParkMate regularly reviews the security of its data. ParkMate cannot guarantee data security, but uses its best efforts in securing all data used.

9.3 Payment Processing: ParkMate does not store Customerโ€™s credit card details. This is contained with the payment processor ADVAM, the use of the ADVAM Gateway and their processes are PCI DSS Level 1 compliant, the industryโ€™s highest level of certification. ADVAMโ€™s processes are reviewed annually via an intensive onsite audit that ensures the highest compliance levels are maintained and adhered to.

10 Intellectual Property Rights

10.1 Ownership: ParkMate or its licensors or assignees own all proprietary and intellectual property rights of the ParkMate App and the Website (including text, graphics, logos, icons) and the software and other material underlying and forming any part of the ParkMate App or the Website.

10.2 Restrictions: You may not without Our prior written permission, in any form or by any means:

10.2.1 adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of the ParkMate App or the Website; or

10.2.2 commercialise, copy, or on sell any information or items obtained from any part of the ParkMate App or the Website.

11 Breach

11.1 Termination: Without limiting any other rights and remedies available to Us, We may without prior notice limit Your use of the ParkMate Services, terminate Your ParkMate account, or refuse to provide the ParkMate Services to You if in Our reasonable opinion You breach these Terms.

11.2 Blocking: ParkMate reserves the right to block anyone from using the ParkMate Services at its sole discretion.

12 Disclaimers

12.1 Risk: You expressly understand and agree that You use the ParkMate App and our ParkMate Services at Your own risk.

12.2 Fraud: While ParkMate and its partners and suppliers have used their reasonable endeavours to ensure that appropriate systems are in place to reduce the risk of credit card abuse and other forms of fraudulent activity, We are not responsible for protecting You and Merchants from credit card abuse or other forms of wrongful or fraudulent activity.

12.3 Cyber Risks: ParkMate does not accept any liability for any damage, loss, cost expense or harm arising directly or indirectly as a result of any computer virus or unauthorised access of Our system.

12.4 Connectivity: ParkMate accepts no responsibility for any inability to use the ParkMate Services that arises from an issue between You and Your network or communication provider.

12.5 Owner Issues: ParkMate accepts no responsibility or liability for any issues which may arise between You and owners of the Carpark Site on which You park

13 Liability and Indemnity

13.1 No Guarantees: We will endeavour to make the ParkMate Services available to You, but We cannot guarantee that the ParkMate Services will be fault free or available 100% of the time. Access to ParkMate Services may be restricted due to maintenance or other uncontrollable outages. Such disruptions will not constitute a breach of Our obligations in providing ParkMate Services.

13.2 Exclusion: Except as provided by the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or otherwise at law:

13.2.1 the liability of ParkMate to You or any other person under or in connection with these Terms, or in connection with the ParkMate Services, the Website, the ParkMate App, or Your use of or inability to use the ParkMate Services, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise; and

13.2.2 Our liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

13.3 Release and Indemnity: By using the ParkMate Services You agree to release and indemnify Us and to keep Us indemnified from and against all actions, claims, costs (including legal costs and expenses on a full solicitor and client basis), losses, proceedings, damages, liabilities, or demands suffered or incurred by Us to any person arising out of or in connection with Your failure to comply with these Terms or failure by You or a Merchant to complete a transaction or out of or in connection with Your use of the ParkMate Services. This includes loss due to any loss of goodwill or reputation.

13.4 Acknowledgement: You acknowledge and understand that these Terms are necessary to protect Our business interests by ensuring compliance with the Terms and Conditions and appropriate allocation of risk between the parties.

14 General

14.1 Force Majeure: To the maximum extent permitted by law, ParkMate has no liability for any lack of performance, or for any failure of Us to comply with these Terms where the same arises from any cause reasonably beyond Our control.

14.2 Consumer Guarantees Act: Nothing in these Terms will limit the effect of the Consumer Guarantees Act 1993 (Act), except to the extent permitted by the Act. Where the ParkMate Services are supplied for the purposes of a business, both ParkMate and the Customer agree that the parties are in trade and of equivalent bargaining power and agree to contract out of the provisions of the Consumer Guarantees Act 1993 to the extent permitted by law.

14.3 No Waiver: If We do not exercise or enforce any right available to Us under these Terms, it does not constitute a waiver of those rights.
14.4 Governing Law: These Terms are governed by the laws of New Zealand. You submit to the nonโ€exclusive jurisdiction of the Courts of New Zealand.

15 Interpretation

15.1 Glossary: In these Terms, the following expressions have the meanings set out:

ADVAM means ADVAM Pty Ltd with PCI DSS as a compliance standard.

Carpark Space / carpark means a car park used by You at the Carpark Site.

Carpark Site / Site means the location of the parking site provided by the Operator.

Customer means a person who is a registered user of the ParkMate Service.

Merchant means a business or service provider who accepts payments for its goods and/or services through the ParkMate App.

Merchant Fees means fees that We charge to cover the cost of electronic payment methods, such as credit cards or debit cards. These fees are a combination of several different costs and include but not limited to gateway processing charges, scheme and interchange fees and bank merchant charges

Operator means a supplier of parking facilities managed through ParkMate.

ParkMate Service or ParkMate App means the app or Website service(s) provided by Us for the online listing and the arrangement of Carpark Spaces at Carpark Sites.

Product means an offering of parking rights with a known expiry date and time through the ParkMate Services.

Session means either a pre-paid or post-paid Session using the ParkMate App by which a Carpark Space can be arranged and used at a Carpark Site based on a start time and expiry time.

ParkMate, We, โ€œUsโ€ and Our are a reference to ParkMate Limited, together with its employees, agents and independent contractors.

Website means the URL address www.parkmate.co.nz.

You and Your are a reference to You the customer.

15.2 ParkMate Terminology and Functions: For the ParkMate Service, the following expressions have the meanings and/or functions set out:
Closed means the Carpark Site is closed and no casual parking is available.

Email Receipts and Notifications are email receipts and notifications which are emailed and/or sent to the Customerโ€™s email address. For example, payment receipts and email parking session notifications are sent to the Customerโ€™s registered email address advising a Session is still running and may need attention by the Customer to stop the active Session on their device. Email Receipts and Notifications can be disabled from within the ParkMate App.

Long Term means parking for longer than 24 hours and may have other restrictions to parking.

Max Stay means time is limited to a maximum period of parking.

Prepaid - Product or Product is an offering of parking rights with a known expiry date and time. Payment is taken at the time of purchase. Product examples are Earlybird, All Day, 24 hrs, Night, 1 Week, Long Term.

Push Notification means a push notification sent to the Customerโ€™s phone advising information pertinent to a Customerโ€™s Session.

Refund Requests means a Customerโ€™s request for a refund.

SMS Notifications are SMS notifications used to send reminder notices and or important information as to ParkMate Services.

Start My Parking means a casual or hourly Session that starts a timer clock displaying the length of time the Customer has parked. Sessions that are not stopped automatically by the ParkMate App require the Customer to manually stop the Session. The Customer must stop the Session when they leave the Carpark Site if the Session is not already stopped. A Customer will be liable for all parking fees post their departure from the Carpark Site if they forget to stop an active Session.

Transaction Fee means, as the context requires, the Surcharge of merchant fees that may be charged by ParkMate to the Customer for the Customerโ€™s use of the ParkMate Service, for utilising payment by means of credit card or contactless debit card and any other transaction fee specified in these Terms.

Unreserved means a Carpark Space arranged or a Long-Term parking right and includes any bay that is not marked โ€œreservedโ€.

1. Introduction to Terms and Conditions

These Terms and Conditions are applicable to a Car Park that operates by:
1.1 Pay by Plate; or
1.2 Pay by Plate and ParkMate; or
1.3 ParkMate and ParkMate Guest.

2. Acceptance of Terms and Conditions

2.1 By entering the Car Park and/or paying by making an online booking through the ParkMate App or ParkMate Guest web page, or by Pay by Plate, You agree to and accept these Terms and Conditions.

2.2 These Terms and Conditions apply from the moment You enter this Car Park or from the time You make an online booking through the ParkMate app or ParkMate Guest web page, whichever occurs first.

2.3 By entering the Car Park or by making an online booking, You also warrant and represent that You are authorised to bind the registered owner of Your Vehicle to these Terms and Conditions.

2.4 We may vary the Terms and Conditions, and any new Terms and Conditions will be binding on You, the Car Park User, upon publication on our website and in our Car Parks.

3. Definitions

3.1 Abandon, in relation to Your Vehicle, means:

3.1.1 leaving Your Vehicle unattended in the Car Park for an extended period without the intention of returning to remove it within the allowed time limit; or

3.1.2 when Your Vehicle is left in a Bay beyond the allowed time limit or in a manner that disrupts normal carpark operations, such as blocking access or occupying a Reserved Bay.

3.7 Authorised Parking (to Park) means having official permission or approval to park a Vehicle in a Bay at any of the Car Parks. Such authorisation can be granted through a booking on the ParkMate app or on the ParkMate Guest web page.

3.8 Breach Notice or Notice means a formal parking enforcement notification issued to a vehicle owner or driver who has violated our Terms and Conditions.

3.9 Car Park means a car park owned, leased, or managed by Wilson Parking New Zealand Limited, where the right to use the car park is managed via by Pay by Plate or ParkMate or ParkMate Guest.

3.10 Car Park Bay / Bay / Space means a designated, reserved or unreserved parking space within any one of the Car Parks, typically marked by lines or boundaries, where a single vehicle can be parked.

3.11 Car Park User means the registered owner and/or the driver of a Vehicle entering the Car Park and includes the purchaser of parking services.

3.12 Car Park User Access Hours means the hours the Car Park User may access the Car Park, as displayed in the Car Park or on our websites.

3.13 Claim means and includes any claim for Damage, loss, or compensation, and any demand, remedy, liability, or action.

3.14 Clamp(ing)(ed) means the immobilisation of a Vehicle parked unlawfully, as defined by Our Terms and Conditions, by attaching an enforcement device to one of its wheels.

3.15 Completed Payment means ensuring that You have made the appropriate payment and completed a transaction in one of Our systems for the parking Session.

3.16 Customer means, the driver of a Vehicle entering the Car Park, and also includes the purchaser of parking services using the ParkMate app or ParkMate Guest web page.

3.17 Damage means and includes any direct, indirect, consequential, and special damage.

3.18 Designated bay / space means a Car Park Bay for You / Customer to use for a particular purpose

3.19 Electronic Pass means, a valid active Session for a Car Park Space, operating through the Onsite Pay by Plate Machine, the ParkMate app, or ParkMate Guest web page.

3.20 Line Marked Parking Bay means a parking Space within a Car Park that is defined by painted lines on the ground indicating the boundaries of each parking Space.

3.21 Mobility Bay means a designated parking Space within a Car Park, marked with a wheelchair symbol, reserved for people with disabilities or those with mobility impairments who hold a valid legal permit to use a Mobility Bay.

3.22 Mobility Bay Breach Fee means a sum of no greater than $250 when You park in a designated mobility parking space without the required Mobility Bay Window Pass.

3.23 Mobility Window Pass means a valid legal permit or identification badge clearly displayed in a Vehicleโ€™s window to indicate that the driver or passenger is authorised to use a Mobility Bay.

3.24 Notice โ€“ see Breach Notice

3.25 Onsite Pay by Plate Machine means, the machine that is located onsite at the pay by plate Car Park by which You, the Customer, can select and purchase a parking product from the Car Park in which the machine is located.

3.26 Outstanding Debt means and includes any and all unpaid parking fees and/ or unpaid Breach Notices.

3.27 Pay by Plate Car Park means a ticketless parking facility where Customers pay for their parking by entering the Vehicleโ€™s licence plate number into a payment machine or mobile app.

3.28 ParkMate app / Mobile app means a smartphone application parking facility where Customers are able to pay for their parking without having to use a pay machine or display a ticket on the windshield.

3.29 ParkMate Guest web page means an online, one-off-web-based parking payment portal, via a mobile where Customers are able to โ€˜pay-on-the-goโ€™.

3.30 Pre-paid means the purchase of a parking product in advance, through a payment machine, Mobile app or web page where payment is made by the Customer before the parking period begins.

3.29 Post-paid means a parking product where the Customer pays for parking after the Session ends, based on the actual time parked using a payment machine, booth or Mobile app.

3.30 Registration means a Vehicle registration certificate issued by the New Zealand Transport Agency (NZTA).

3.31 Relevant Laws and Regulations mean all legal rules and guidelines established by local, regional or national authorities that govern how the Car Park should be used including, but not limited to, traffic and parking regulations, health and safety regulations, privacy laws and contractual agreements.

3.32 Reserved Bay means a designated Car Park Bay, at the specified Car Park, set aside exclusively for You / Customer

3.33 Session means the time, which can be either pre-paid or post-paid, purchased at the Onsite Pay by Plate Machine, or the ParkMate app or ParkMate Guest web page, by which a right to use a Car Park Space can be purchased and used based on a start time and expiry time.

3.34 Surcharge or Electronic Transaction Fee means an additional amount where You select a payment method by means of credit card or contactless debit card. This amount is reflected on our signage and our website. An Alternative Payment Method is available via our website www.pesnz.co.nz/payments

3.35 Terms and Conditions means these Terms and Conditions, as amended from time to time by us.

3.36 Tow(ing)(ed) means the removal of a Vehicle that is parked unlawfully, according to these Terms and Conditions, and its transportation to a designated storage area at the ownerโ€™s expense.

3.37 Valid Parking Right means the legitimate authorisation / permission to park a Vehicle in a specific area of a Car Park.

3.38 Vehicle refers to any device driven or propelled on roads or public pathways to transport people or goods, including motor vehicles, motorcycles, and scooters, powered by motor or electric battery, along with its accessories and contents. 'Your Vehicle' refers to the vehicle You enter the car park in, regardless of ownership or registration.

3.39 We, our, and us means as the context permits, ParkMate Limited and/or Parking Enforcement Services, a division of Wilson Parking New Zealand Limited, and includes any of Wilson Parking New Zealand Limitedโ€™s employees, agents, and independent contractors.

3.40 You and Your is a reference to You, the Customer.

3.41 Warrant of Fitness (WoF) means the mandatory certification to confirm a Vehicle has met the required safety standards at the time of inspections.

4. Payment Terms and Process
To ensure a Valid Parking Right applies, You agree to follow and complete the payment process set out below and adhere to these Terms and Conditions, which apply 24 hours a day, 7 days a week. You agree :

4.1 when using any of our Pre-Paid Car Parks such as Pay by Plate, ParkMate and ParkMate Guest, payment must be made immediately upon parking Your Vehicle. Payment cannot be made only when You are ready to leave the Car Park.

4.2 where using a Pre-Paid Car Park, failure to pay upon parking constitutes a breach of these Terms and Conditions.

4.3 it is Your responsibility to ensure an active Session is operational while Your Vehicle is using the Car Park Space at a Car Park, and:

4.3.1 should You use a Pay by Plate Car Park, Your parking Session has an expiry date and time, and it is Your responsibility to monitor Your parking Session and leave by the appropriate time prior to expiry.

4.3.2 should You use the โ€˜casual functionโ€™ of the ParkMate App and ParkMate Guest Web Page or Mobile App bookings that allows users to manually start and stop a parking Session, it is Your responsibility to stop Your parking Session on leaving the Car Park. You will be responsible for paying all parking charges post departure if You fail to end the active Session.

4.3.3 Should You use the ParkMate and ParkMate Guest Web Page or Mobile App bookings and select a Pre-Paid parking product, Your parking Session has an expiry date and time, it is Your responsibility to monitor Your parking Session and leave by the appropriate time prior to expiry.

5. Parking Compliance Rules

5.1 You agree to observe and conform to all rules or directions displayed in the Car Park and to comply with all Relevant Laws and Regulations relating to the use of the Car Park and agree:

5.1.1 not obstruct other persons or vehicles using the Car Park and

5.1.2 You agree not to Abandon Your Vehicle in the Car Park;

5.1.3 not park in any Car Park Bay marked โ€˜reservedโ€™ unless You possess a legal licence or lease to park in that Car Park Bay, and

5.1.4 not park in any area marked โ€˜no parkingโ€™ or outside of the Line Marked Parking Bays;

5.1.5 not park in a Mobility Bay without a current Mobility Window Pass displayed;
5.1.6 not park in any Bay unless You have Completed Payment and hold a Valid Parking Right; and

5.1.7 not park in any Bay unless You have been Authorised to Park in that Car Park Bay; and

5.1.8 use the Car Park only during the Car park User Access Hours.

5.2 You warrant that Your Vehicle has a current Warrant of Fitness and Registration, is roadworthy and can be driven under its own power and will not present any danger or risk to other vehicles or persons or the Car Park.

6. Default of Payment

6.1 You must not park Your Vehicle at the Car Park using a Post-Paid method if You knowingly do not have sufficient funds to pay for the Post-Paid parking product.

6.2 In the event that Your credit card transaction declines or dishonours, we reserve the right to re-process the transaction and charge an additional fee of $30 in respect of our administrative costs in re-processing the transaction.

6.3 You acknowledge and understand that the above terms are reasonably necessary to cover our reasonable costs of administration and to protect our legitimate business interest.



7. Electronic Pass

7.1 You may use the Onsite Pay by Plate Machine, or ParkMate app or ParkMate Guest web page to purchase an Electronic Pass for a parking Session. The Electronic Pass is valid for the entire duration of Your Vehicleโ€™s parking Session.

7.2 When You purchase an Electronic Pass, You are granted the right to use a Car Park Space at the Car Park.

7.3 It is Your responsibility to correctly identify Your Vehicle, select the right parking product, and manage the duration of the parking Session.

7.4 You may amend or extend a Session by either using the Pay by Plate Machine or, where applicable, through the ParkMate app or ParkMate Guest web page.

8. Breach Notices

8.1 If You breach these Terms and Conditions, You agree that Your parking is unlawful and unauthorised. We may issue a Breach Notice by post or email, requiring payment of a Breach Fee of up to $85. For breaches of clause 5.1.5 (failure to display a valid mobility pass in a mobility bay), a Breach Fee of up to $250 applies. Payment is due within 21 days of the Breach Notice date.

8.2 This Breach Fee represents the reasonable costs of enforcing these Terms and Conditions.

8.3 If You are issued with a Breach Notice and You do not pay the sum specified in that Breach Notice within 21 (twenty-one) days of the date of the Breach Notice, then we will send a reminder Breach Notice, and You agree to pay the further sum of $20.00, being our reasonable administrative costs in sending the second notice (Reminder Notice).

8.4 A Surcharge will apply if You choose to pay by credit card or contactless debit card. You can make an online payment without the Surcharge using our payment portal www.pesnz.co.nz/payments.

8.5 If You are issued a Reminder Notice, and You do not pay the sums specified within 7 (seven) days of the dates of the Reminder Notice, You agree that:

8.5.1 we may use a debt collection agency to enforce payment of the sums owing by You, together with the cost of such debt collections; and

8.5.2 You will be liable for any costs and expenses incurred by us to enforce payment of the money owing by You, including our solicitor / client costs.

8.6 If You wish to appeal any Breach Notice You have been issued or sent, please visit www.pesnz.co.nz/appeals.

8.7 You acknowledge and understand that the above Terms are necessary to cover our enforcement and administration costs and to protect our business interests by ensuring compliance with the Terms and Conditions.

9. If Your vehicle is Clamped or Towed

9.1 You agree that we may Clamp or Tow Your Vehicle from the Car park at Your own risk and expense, if:

9.1.1 You breach any of these Terms and Conditions, as an alternative to us issuing You with a Breach Notice; or

9.1.2 Your Vehicle has been used or parked in a manner that has repeatedly breached these Terms and Conditions; and / or

9.1.3 has multiple outstanding Breach Notices in anyone of our Car parks; and / or

9.1.4 one or more outstanding Breach Notices have been issued in relation to Your Vehicle and any of those Breach Notices have been outstanding for 35 (thirty five) or more days.

9.2 If Your Vehicle is Clamped, You agree to payment of the prescribed $100 amount (section 98C of the Land Transport Act 1998) for the removal of the clamp.

9.3 If Your Vehicle is Towed, You agree that we may hold Your Vehicle until the Outstanding Debt, plus any fees under clause 9.5, have been paid in full;

9.4 If You do not pay the Outstanding Debt, plus any fees under clause 9.5 within 28 (twenty-eight) days of Your Vehicle being Towed, You accept the risk that the towing company may sell Your Vehicle in order to offset the Outstanding Debt and the costs that it has incurred that are associated with Your breach.

9.5 If Your Vehicle is Clamped or Towed, You agree that Your Vehicle will be released only upon payment of the release fee and/or the release fee from the towing company including any storage fees in addition to payment of any Outstanding Debt owed by You to us.

9.6 You acknowledge and understand that the above Terms are necessary to cover our enforcement and administration costs and to protect our business interests by ensuring compliance with the Terms and Conditions.

9.7 In the event Your Vehicle has been Clamped and/or Towed, call ParkWatch at 09 375 5056.

10. Responsibility for Damage and Injury

10.1 You agree that You will be liable for any Damage to the Car Park caused by You or Your Vehicle.

10.2 Your Vehicle will remain solely at Your own risk and is Your sole responsibility while it is in the Car Park.

10.3 While we shall take all reasonable care, we cannot guarantee the security of Your Vehicle or its contents.

10.4 Except to the extent provided by the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or otherwise at law, our liability for any Claim by You or any other persons, including (but not limited to):

10.4.1 any Claim for loss or Damage to Your Vehicle; or

10.4.2 for loss or Damage to the contents of Your or any other Vehicle; or

10.4.3 resulting from using the Car Park or being unable to use the Car Park; or

10.4.4 for negligence or personal injury or otherwise,
will be limited, at our discretion, to providing a refund of the specific parking fee paid by You for the parking service giving rise to the liability.

10.5 We accept no liability for any loss or Damage to any article left in our custody or control. Our personnel are not authorised to accept any of Your possessions for safe custody, except the We are not liable for any loss or Damage to items left in our custody or control. Our staff are not authorised to accept any of Your belongings for safekeeping, except for Your Vehicle keys, and only when we specifically request possession of them.

10.6 You agree to indemnify us in respect of any Claim made against us arising from Your use of the Car Park or the use of the Car Park by anyone else acting on Your instructions, implied or otherwise, or under Your authority.

10.7 You acknowledge and understand that the above Terms are necessary to cover our enforcement and administration costs and to protect our business interests by ensuring compliance with the Terms and Conditions and appropriate allocation of risk between parties.

11. Miscellaneous

11.1 In the event Your Vehicle is in breach of these Terms and Conditions, You agree to provide us with Your full name and address if asked by us.

11.2 We may obtain the registered owner's name and address from the motor vehicle register and share it with third parties for debt recovery purposes under these Terms and Conditions, even if You or the owner has opted out of providing this information.

11.3 If You are not the registered owner of Your vehicle, We may request Your name and contact details from the registered owner if You breach these Terms and Conditions. You authorize the registered owner to provide this information to us for this purpose.

11.4 If We fail to act or pursue any right or remedy available to Us, this will not in any way prejudice Our right to exercise that or any other right or remedy.

11.5 No one is authorised to amend or waive these Terms and Conditions or amend or waive any Breach Notices issued for any breach of these Terms and Conditions by You or make representations on our behalf (unless confirmed by Us in writing).

11.6 We may use licence plate recognition (LPR) in the Car Park to monitor compliance with these Terms and Conditions. If requested, You agree to provide Us with Your Vehicle licence plate recognition (LPR) details when obtaining Your parking ticket or window pass or when making an electronic payment.

11.7 We may use visual and audio surveillance and recording equipment in and around the Car Park for the purpose of protecting our lawful interests, and for protecting the safety or our employees, agents and contractors and Our Customers.
